Probation

PROBATION DEPARTMENT   

The Common Pleas Court accepted supervision of misdemeanant offenders in 1984 from the three (3) County Area Courts and began supervising those offenders. In 2018, the three Area Court Judges along with the Court Administrator established a Probation Department and appointed a Chief Probation Officer, and two Probation Officers.  A third Probation Officer was added in 2019. 

The benefits of an Area Court Probation Department are:

  1. One department that handles all misdemeanant offenders from the Courts
  • Less chance of offenders manipulating programs
  • Probation Officers that are able to provide full time services to all (3) Courts
  • Probation Officers that can provide coverage for each other
  • More consistent handling of offenders
  • Continuous Court coverage/ better communication
  • Able to provide more “in court” time to the Judges
  • Stream lined forms and reports

Probation General Supervision

This unit consists of Probation Officers who supervise persons placed on community control under direct (basic) supervision. Cases are referred directly by the Courts for community control along with the offenders who are referred from the Area Courts Addiction Treatment court (ACAT) and the Mental Health Treatment Alternative Court (TAC). These are offenders placed on community control with identified needs addressed by this specialty Court. It should be noted that the Area Courts will assess a flat supervision fee of $250.00, to the defendant, per year when community control is ordered.

In addition to Officers responsibilities, if you are sentenced to Monitored Time, you are required to avoid any further violations of the law.  The Judge may also set other terms for your Monitored Time such as attending counseling, treatment programs, or payment of restitution.  If you violate or fail to comply with the terms of your Monitored Time,  you may be summoned to appear before the Judge; if you fail to make this appearance, your Monitored Time may be revoked and a warrant may be issued for your arrest. It should be noted that the Area Courts will assess a flat fee of $50.00, to the defendant, per year when Monitored Time is ordered.

Officers are also required to respond to issues with offenders placed on GPS,  electronically monitored house/SCRAM or that may have an ignition interlock device. They also ensure compliance with any court ordered sanction.

The department is also responsible for offender assessments, evaluations and pre-sentence investigations, sealing of records and any other investigations ordered by the Court. It should be noted that the Area Courts will assess a fee of $35.00, to the defendant, when a pre-sentence investigation is ordered.

The Probation Department is an integral part of the Courts, and only with a coordinated relationship between the Courts and the Probation Department can the goals of these Courts be satisfied and the community served with better results. It is necessary for the Probation Department and the Court to establish programs to effectively deal with the offender coming before the Court.

The major goals of the Area Courts Probation Department are as follows:

  1. The protection of the community
  2. The rehabilitation of the offender
  3. Provide appropriate services to the Court

  • Pay restitution, fines, court costs and fees.
  • Fully participate in all programs and services to positively change his or her life through proactive interventions to become a law abiding citizen.

GOAL:

Provide community protection by holding offenders accountable through assessments and treatment, appropriate level of supervision and sanctions, and compliance with the orders of the Court.
To divert appropriate offenders from the Butler County Jail and supervise them in the community and direct them to the appropriate services for their Court ordered sanctions and identified needs.
